Lundin and\u00a0<\/span><span dir=\"ltr\">Director Alex Schneiter in rela<\/span><span dir=\"ltr\">tion to past operations in Su<\/span><span dir=\"ltr\">dan from 1999-2003 and 2000-2003,\u00a0<\/span><span dir=\"ltr\">respectively. The charges also include claims ag<\/span><span dir=\"ltr\">ainst the Company for a corporate fine of SEK\u00a0<\/span><span dir=\"ltr\">3,000,000 and forfeiture of economic benefits of<\/span><span dir=\"ltr\">\u00a0SEK 1,391,791,000, which according to the\u00a0<\/span><span dir=\"ltr\">Swedish Prosecution Authority represents the va<\/span><span dir=\"ltr\">lue of the gain of SEK 720,098,000 that the\u00a0<\/span><span dir=\"ltr\">Company made on the sale of the business in 2003. Following the bringing of charges, Ian H.\u00a0<\/span><span dir=\"ltr\">Lundin has chosen not to stand for re-election as Chairman of the Board at the Company\u2019s 2022\u00a0<\/span><span dir=\"ltr\">Annual General Meeting. The Company refutes th<\/span><span dir=\"ltr\">at there are any grounds for allegations of\u00a0<\/span><span dir=\"ltr\">wrongdoing by any of its representatives and does not foresee any impact on the operational and\u00a0<\/span><span dir=\"ltr\">financial guidance that the Company has set out previously.<\/span><\/p>\n<p><span dir=\"ltr\">The indictment states that Ian H. Lundin and Alex Sc<\/span><span dir=\"ltr\">hneiter are accused of complicity in crime against\u00a0<\/span><span dir=\"ltr\">international law, gross crime, in Suda<\/span><span dir=\"ltr\">n 1999-2003 and 2000-2003, respectively.<\/span><\/p>\n<p><span dir=\"ltr\">Both Ian H. Lundin and Alex Schneiter strongly deny\u00a0<\/span><span dir=\"ltr\">the charges and have the full support of the Board in\u00a0<\/span><span dir=\"ltr\">contesting them at trial. They will both remain on<\/span><span dir=\"ltr\">\u00a0the Board as Directors and the wider management and\u00a0<\/span><span dir=\"ltr\">operations of the Company will remain unaffected.<\/span><\/p>\n<p><strong><span dir=\"ltr\">Ian H. Lundin, Chairman of Lundin Energy commented:<\/span><\/strong><\/p>\n<p><em><span dir=\"ltr\">&#8216;This is an incomprehensible decision by the Swedish\u00a0<\/span><span dir=\"ltr\">Prosecution Authority since it is not supported by any\u00a0<\/span><span dir=\"ltr\">evidence in the investigation, a situation that has not changed for the last eleven years. I would like to personally\u00a0<\/span><span dir=\"ltr\">thank all of our shareholders and partners for the support<\/span><span dir=\"ltr\">\u00a0you have given the Company, as well as Alex and me.\u00a0<\/span><span dir=\"ltr\">I know that we have done no wrong and that we will ultimately prove this in court. It has been an honour and a\u00a0<\/span><span dir=\"ltr\">privilege to serve as Chairman of Lundin Energy for the pa<\/span><span dir=\"ltr\">st 20 years. During that time the Company has evolved\u00a0<\/span><span dir=\"ltr\">from a small E&amp;P company to a leading independent energy<\/span><span dir=\"ltr\">\u00a0producer with one of the lowest carbon emission\u00a0<\/span><span dir=\"ltr\">intensities in the whol<\/span><span dir=\"ltr\">e upstream sector&#8217;.<\/span><\/em><\/p>\n<p><span dir=\"ltr\">The Company remains extremely concerned about the fairness,<\/span><span dir=\"ltr\">\u00a0reliability and legal basi<\/span><span dir=\"ltr\">s of the investigation and\u00a0<\/span><span dir=\"ltr\">about the credibility and accuracy of the NGO reports that\u00a0<\/span><span dir=\"ltr\">seem to form the basis of the Prosecution case. In the\u00a0<\/span><span dir=\"ltr\">Company\u2019s firm opinion, there is no evidence linking an<\/span><span dir=\"ltr\">y representative to the alleged primary crimes and this\u00a0<\/span><span dir=\"ltr\">will be fully demonstrated at trial. The Company is firmly convinced that it was a positive force for development\u00a0<\/span><span dir=\"ltr\">in Sudan and operated there responsibly, as part of an<\/span><span dir=\"ltr\">\u00a0international consortium, and in full alignment with the\u00a0<\/span><span dir=\"ltr\">policy of constructive engagement endorsed by the UN, EU and Sweden at the time.<\/span><\/p>\n<p><span dir=\"ltr\">The indictment also includes claims against the Company\u00a0<\/span><span dir=\"ltr\">for a corporate fine of SEK 3,000,000 and forfeiture\u00a0<\/span><span dir=\"ltr\">of economic benefits of SEK 1,391,791,000, which accord<\/span><span dir=\"ltr\">ing to the Swedish Prosecution Authority represents the\u00a0<\/span><span dir=\"ltr\">value of the gain of SEK 720,098,000 that the Company ma<\/span><span dir=\"ltr\">de on the sale of the business in 2003. Whilst\u00a0<\/span><span dir=\"ltr\">the forfeiture amount has been materially reduced from<\/span><span dir=\"ltr\">\u00a0that previously announced by the Swedish Prosecution\u00a0<\/span><span dir=\"ltr\">Authority in 2018, the Company believes that there is no\u00a0<\/span><span dir=\"ltr\">legal basis for any such claim. This is another step in\u00a0<\/span><span dir=\"ltr\">the legal process and whilst it may take many years to\u00a0<\/span><span dir=\"ltr\">reach a conclusion, the Company sees no circumstance in\u00a0<\/span><span dir=\"ltr\">which a corporate fine or forfeiture could become payable as there are no grounds for any allegations of\u00a0<\/span><span dir=\"ltr\">wrongdoing by any of its representatives.<\/span><\/p>\n<p><span dir=\"ltr\">The Company continues to assess the indictment and will respond in detail following further analysis.
